Outsourcing Software Development to India From the UK: Costs, Contracts and UK GDPR
What UK companies should know before outsourcing development to India: real costs, contracts and IP, UK GDPR transfers and working across the time difference.

Quick answer
Outsourcing software development from the UK to India works well when three things are in place: a written scope and price before any build starts, a contract that covers IP and UK GDPR transfers, and a working rhythm built around the 3.5 to 4.5 hours of shared office time each day. Get those right and a UK startup or SME can build more for the same budget without losing control of the product.
This guide covers what it costs, how the contracts and data rules work, how the time difference plays out day to day, and when outsourcing is the wrong call.
Why UK Companies Outsource to India#
The usual trigger is cost and hiring speed. A senior developer in London is a large fixed cost and can take months to hire, and UK agency day rates make a first product or a second product line hard to fund. India has a deep pool of experienced engineers who already work in English for UK and US clients.
The concern is rarely the code itself. It is whether the team will understand the product, stay reachable and write software a future UK hire can maintain. That is a process question, and it is the part to check most carefully when you compare vendors.
What Does It Cost?#
A 2026 UK agency guide puts a typical MVP built by a UK agency at about £10,000 to £25,000 and a full production product at £30,000 to £150,000 ( Magora, 2026). India-based teams usually quote less for the same scope, but quotes vary widely between vendors and are hard to compare on day rate alone.
Compare cost per shipped feature, not hourly rate. A cheaper team that needs twice the time, or produces code you later rewrite, costs more. At Limbani Softwares projects start from $1000 and are priced on scope after a discovery call; see our pricing page for what drives the number.
- Scope. The number of features, user roles and screens is the biggest driver.
- Platforms. Web only is cheaper than web plus iOS plus Android.
- Integrations. Payments, CRMs, accounting tools and legacy systems each add design and testing time.
- Compliance. Audit logs, data residency and security testing add effort but are often required.
- Ongoing costs. Hosting, third-party APIs and maintenance continue after launch.
Contracts, IP and NDAs#
Your contract should state that you own the source code, designs and documentation, that code lives in your own GitHub or GitLab organisation, and that cloud accounts are in your company's name. Sign an NDA before sharing anything sensitive. Many UK companies prefer the services agreement under English law; a good vendor will review your template rather than insist on theirs.
- IP assignment. All work product assigned to you on payment.
- Repository access. Your organisation owns the repository from day one.
- Exit terms. Handover of code, credentials and documentation if the engagement ends.
- Change control. How scope changes are priced and approved.
UK GDPR: Sending Data to a Team in India#
Under UK GDPR you remain the controller and the vendor is your processor, so you need a data processing agreement with Article 28 terms. India does not have UK adequacy status, so any transfer of personal data needs an approved mechanism, normally the ICO's International Data Transfer Agreement (IDTA) or the UK Addendum to the EU Standard Contractual Clauses, plus a transfer risk assessment. The ICO guidance on international transfers explains both.
The simplest way to reduce risk is to keep personal data out of development altogether: use test or anonymised data, keep production in a UK or EU cloud region in your own account, and give the offshore team only the access they need, logged per person.
Working Across the Time Difference#
India is 4.5 hours ahead of the UK in summer and 5.5 hours ahead in winter. A team working 09:00 to 18:00 India time is online for the whole UK morning, so stand-ups, demos and decisions happen before lunch. Anything raised in the UK afternoon is usually picked up early the next day, which means work continues while you are offline.
- Daily. Short written update and a stand-up in the UK morning.
- Every two weeks. Sprint demo and planning call.
- Always. Shared task board, repository and staging environment.
How to Choose an Offshore Partner#
Ask for case studies in your domain and talk to the engineers who would build your product. Check that they write scope documents, run sprint demos and give you repository access from day one. Read independent reviews on Clutch, and ask how they handle a missed estimate. Our guide on choosing a software development company has a fuller checklist.
When Outsourcing Is the Wrong Choice#
- You need developers in your office several days a week.
- Your contracts require UK security clearance for every engineer.
- Your process depends on constant real-time collaboration across the whole UK day.
What Changes for US Startups Outsourcing to India#
For US companies the time difference is larger: India is 9.5 hours ahead of New York and 12.5 ahead of San Francisco, so overlap is the US morning on the East Coast and early morning on the West Coast. Teams that do well plan one shared hour for stand-ups, rely on written updates and use the overnight gap as an advantage: feedback given in the US afternoon is built by the next morning. Data-protection work is lighter than in the UK unless you handle health or financial data, where HIPAA safeguards or PCI rules shape the architecture. Contracts are usually under the law of the client's state, with IP assignment and an NDA.
The best offshore software development company for a US startup is the one that shows you production work, writes scope down, and keeps the code in your repository; see our page for US businesses.
